In Florida, these setbacks are determined per property, based on your local city and county ordinances. You may have 30 feet of backyard behind your house, but you could find out that you have a 15 foot drainage & utility easement (DU&E), leaving only 15 feet of available space to work with.


Your zoning department may have additional rules that could impact your plans. Be sure to also ask about what the percentage limits for impervious areas are on your property. In most cases, this is calculated as:


(the base footprint of the home + all additional concrete/covered surfaces - driveways, walkways, air conditioner pad, etc. + your planned pool size + the pool deck) / your lot square footage * 100 = X


Some jurisdictions have rules regarding the distance from the waterline to the setback line, or property line, some require a minimum distance from the outer pool wall, and others may state the minimum distance is from the back edge of the pool deck.


Because of changing ordinances and rules, this information is not always easy to access. Basic setback requirements regarding waterlines, pool decks and screen enclosures, and minimum setbacks may be available through building department documentation. This is just general information. The specific details that apply to your property will have to come from zoning, as the general information may contradict your specific property requirements!


The permitting process is more intricate than most people think. Be patient with this part of the process, because your contractor is now at the mercy of your building department's timelines- not theirs or yours! All plans are typically reviewed by zoning, then a building department representative before approving for permit or requesting changes. Even the most seasoned contractors are asked for plan revisions, due to changes in laws and ordinances.


Building a pool without the required permits can lead to a financial headache, not to mention potential fines. Be sure your contractor obtains  all the necessary permits and approvals from the appropriate authorities before breaking ground. Trust us, avoiding any bureaucratic belly flops is worth the effort.
